The University Payments Website – Terms of Use

(*Wherever the masculine gender is used, it also refers to the feminine gender)

 

  1. General: Before surfing and/or any use of the University's payments Website, you are hereby asked to read carefully the terms of use, which constitute a binding legal basis for the transactions and services executed via this Website.  Anyone executing a transaction on the Website effectively declares that he has read and consented to the terms of use, and that neither he nor anyone on his behalf will have grounds for any claim or action against the University, except for claims relating to a breach of an explicit undertaking by the University under these terms of use.  The University reserves the right to change the terms of use from time to time.  The change shall be effective as soon as it is published on the Website.
  2. 2.              The University may at any time discontinue and/or change all or part of the services on the Website.
  3. 3.              Pre-conditions for executing a transaction on the Website:Every surfer may use the Website, provided he is over 18 years old and either holds a credit card that is valid in Israel issued by one of the credit companies authorized to operate in Israel, or possesses explicit authorization from the holder of such a card.
  4. Prohibited Use of the Website: Use of this Website is restricted to making the payments listed on the Website.
  • The Website may not be used for any purpose that is unlawful.
  • The Website may not be used and/or no action may be adopted that can disrupt the operation of the Website and/or harm other users or interfere with their use of the Website.
  • The Website may not be used in any manner that could damage, disable, overburden or impair the Website or third parties in any other way.
  • No transaction is permitted on the Website under another person's identity.
  • It is prohibited to copy, reproduce, duplicate, disseminate, display, charge, transmit, publish, revise, sell, modify and/or commercially use the contents of the Website in any manner or form whatsoever.
  • Should the user breach the terms of use of the Website, the University may immediately discontinue the service without any advance notice, and without derogating from any other right available to it by law. Moreover, the user undertakes to indemnify the University and to release it from any liability in the event that a claim is filed by a third party for breach of the terms of use and/or prejudice of third party rights.
  1. Choice of Law and Jurisdiction: The competent court in the Beer Sheva District only shall be vested with sole jurisdiction to deliberate any legal proceeding on a cause stemming from a transaction executed on or through this Website. The information on the Website, the user’s access to it, and the use made of it shall be solely governed by the laws of the State of Israel.   

 

  1. Confidentiality and Information Security:  The particulars disclosed by the user for the purpose of executing payments shall be stored by the University in compliance with privacy protection laws. The University employs reasonable and generally accepted security measures.  Notwithstanding, there is a risk that the databases could be penetrated. As long as the University adopts reasonable security measures, it shall not be liable for damage caused as a result of such penetration and transfer of information concerning the user, or information disclosed to any third party whatsoever, as a result of such penetration.
  2. Liability: The University takes reasonable measures in order to ensure the uninterrupted availability of the Website and the integrity of its content and services, but it cannot guarantee that use of the Website will be free of malfunctions, disruptions or errors.  The University is not and shall not be liable, directly and/or indirectly, for any damage of any type or form, inconvenience, or loss (including direct, indirect, or consequential damage, loss of profit or mental anguish, etc.) resulting from the use of (including an inability to use) the Website and the various services provided on it.  The University shall not be liable in respect of any delay whatsoever resulting from difficulty in using the Website, inaccuracy of information, a computer virus, or incompatibility between it and the user’s software or files, or any other fault on the Website.
  3. 8.              Copyright and Intellectual Property Rights: The intellectual property on the Website, including its design, content, software, applications, computer code, graphic files, images, designs, texts, and any other information on the Website and/or relating to it (the "Website content”) are owned exclusively by the University or a third party with which it has contracted for the purpose of setting up the Website.  You may not modify, copy, disseminate, transmit, display, execute, duplicate, publish, sell any of the information items , software, or services originating from this Website, including images and/or the University’s symbols.
  4. 9.             The payment: It is hereby clarified that every payment is subject to approval of the transaction by a credit company or bank through which the user undertook to effect the payment.  The user shall have no grievance or demand against the University in respect of failure to approve the payment for any reason whatsoever.  The actual use of the ordered service shall require the presentation of confirmation of payment as a condition for receiving the service.
  5. Cancellations: As a rule, the University shall not accept any requests to cancel a transaction, and the ordering of a service on the Website shall be binding upon the user, even if he does not actually use the ordered service.  In exceptional cases only, at the University’s exclusive discretion, the University shall consider requests to cancel a transaction. This Website does not allow cancellation of transactions, and any request for cancellation of a transaction should be directed to the contact person listed in the payment confirmation.  The user shall be precluded from making any claim or demand against the University for refusal of a request to cancel a transaction.
